Welcome to Combinu (“Combinu,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Combinu platform, website, dashboard, and related services (collectively, the “Platform”). By creating an account or using the Platform, you agree to these Terms.

1. Definitions

  • Platform: The Combinu website, dashboard, and related digital services.
  • User / You: Any individual or entity that creates an account or uses the services.
  • Customer / End User: Your contacts and end-users whose data you manage through the Platform.
  • Services: CRM, unified inbox, automation, AI features, forms, funnels, websites/hosting, reputation tools, and communication services (SMS/Voice/WhatsApp/Email) and related features.

2. Eligibility & Authority

You must be legally able to enter into a binding agreement. If you use Combinu on behalf of a company, you confirm you have authority to bind that company.

3. Account Creation & Security

  • You must provide accurate and up-to-date information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • All activity performed through the account is deemed authorized by the account owner.
  • Combinu may suspend or terminate accounts in cases of suspected abuse, fraud, or policy violations.

4. Free Trial & Provisioning

If a free trial is offered, the trial begins at $0 today unless otherwise stated at checkout. During trial, certain features may be limited, and telecom/messaging services (calls/SMS) may remain inactive until activation/upgrade and compliance requirements are satisfied.

Manual provisioning: Combinu may require manual setup (including workspace creation and snapshot loading), which may take up to 1 business day.

5. Subscriptions, Billing & Renewals

  • Services are provided on a subscription basis (monthly, yearly, or as otherwise specified).
  • Subscriptions renew automatically unless canceled before the renewal date.
  • Fees are generally non-refundable unless required by law or explicitly stated in writing as part of a promotion.

6. Telecom & Messaging Fees (Calls/SMS/WhatsApp/Email)

Certain Services depend on third-party providers (telecom carriers, aggregators, email providers, and Meta/WhatsApp). As a result, usage may incur pay-as-you-go telecom/messaging charges after activation/upgrade, based on usage and provider pricing. Availability and pricing may vary by country, carrier, and usage type.

Starter usage allowance (if offered): If Combinu provides a starter allowance for calls/SMS after activation, it is a promotional benefit, may have limits, and may be modified or discontinued at any time.

7. Fair Use Policy

To protect the quality of service, Combinu may apply a reasonable Fair Use Policy, including but not limited to:

  • The Smart Social Studio feature includes up to 200 AI-generated social posts per month for normal usage.
  • Excessive or abusive usage may result in throttling or suspension of certain features until the next billing cycle.

8. Compliance Obligations

You are solely responsible for compliance with all applicable laws and provider policies, including opt-in/consent requirements for SMS and messaging campaigns, and any required disclosures/opt-out mechanisms.

9. Prohibited Use

Users may not use the Platform for:

  • Sending unsolicited messages or bulk spam without proper consent.
  • Fraudulent, misleading, or illegal activities.
  • Violating Meta/WhatsApp or telecom provider terms and policies.
  • Distributing malware, viruses, or harmful content.
  • Attempting to compromise, overload, or disrupt the Platform’s infrastructure.

10. Artificial Intelligence & Output Content

  • Combinu provides AI-powered tools to assist with messaging, content, and automation.
  • You are responsible for reviewing AI-generated content before using it.
  • AI outputs may be inaccurate, incomplete, or inappropriate.
  • Combinu is not liable for losses resulting from reliance on AI-generated outputs.

11. Third-Party Services

Combinu may rely on third-party services. Third-party outages, policy changes, account restrictions, carrier filtering, number blocks, or deliverability issues may affect services. Combinu is not responsible for third-party enforcement actions or outages.

12. Limitation of Liability

  • Combinu does not guarantee specific business, marketing, or financial results.
  • Combinu is not liable for data loss or business interruption caused by third-party providers, network issues, or user error.
  • Combinu is not responsible for penalties, blocks, or delivery issues imposed by carriers, Meta/WhatsApp, or other providers.
  • Maximum aggregate liability is limited to the value of one monthly subscription fee.

13. Suspension or Termination

  • Combinu may suspend or terminate a User account for violations, abuse, fraud, or non-payment.
  • If a subscription remains unpaid or inactive for more than 60 days, Combinu may delete the account and associated data.

14. Governing Law

These Terms are governed exclusively by the laws of the State of Wyoming, USA. Any dispute shall be subject to the exclusive jurisdiction of the courts located in Wyoming.
